Durable Power of Attorney:
Execution of a Durable Power of Attorney allows the agent (usually a trusted
family member or friend) to sign on behalf of the principal, allowing for
payment of bills or access to money if the principal is unable or unwilling to
handle his or her finances. The agent is under a fiduciary responsibility and
must act in the best interests of the principal.
These matters can best be understood in a personal conference with an attorney
who can explain these matters in further detail.
Living Will:
The Living Will allows an individual to make known his or her desires on whether
life shall be artificially prolonged in the event of an incurable injury,
disease or illness. When death will occur with or without life-sustaining
procedures -- and those procedures only serve to artificially prolong the dying
process -- this document provides direction. Most commonly , it directs that
life-sustaining procedures be withheld and permits the individual to die
naturally with only the administration of medication or performance of medical
procedures necessary to provide comfort care.
The Durable Power of Attorney for Health Care Decisions appoints an agent for
health care decisions. The agent is given authority to handle all medical
affairs and make appropriate medical decisions in conformity with the desires
expressed in the Living Will.
